§ 2-3-3. Certain procedures concerning the development of the agenda for council meetings and the conduct of meetings, generally.

  • (a)

    Agenda development.

    (1)

    The city manager shall determine what items are placed on the agenda for regular and special council meetings, except that any single council member may require that an item be placed on the agenda. Any member of the public who has had a request to have an item placed on the agenda denied by the city manager may have such item placed on the agenda if two (2) or more council members so request.

    (2)

    All agenda items, with any supporting exhibits or attachments, must be submitted to the city clerk no later than 5:00 p.m. of the Tuesday before regular council meetings, and no later than noon of the third working day before any non-emergency special meeting. Agenda items for emergency meetings shall be submitted as soon as possible.

    (3)

    Attachments or exhibits for agenda items submitted by council members that are not submitted by the deadline set forth in the preceding subsection shall not be discussed until all council members have had at least three (3) work days to review the material or all have consented to a sooner discussion of such late submittals.

    (4)

    Agenda items shall be presented to council members under a cover sheet that includes, at a minimum, a summary statement of the subject and content of the agenda item, and an indication of the party requesting the item. The party requesting a discussion in closed session shall be noted on the agenda.

    (b)

    Time limit. Unless approval is granted by the city manager prior to the meeting, which shall be granted sparingly, the presentation of any single agenda item shall be limited to fifteen (15) minutes, regardless of the number of presenters, not counting time taken by comments or questions from council members or the public, if permitted. The mayor, or another holding the gavel, may grant a short extension of time, on a case by case basis, to allow for the conclusion of a presentation.

    (c)

    Public comment. No member of the public may speak to any agenda item except:

    (1)

    When the item is set for public hearing or

    (2)

    When a majority of the council or the presiding officer indicates a desire to hear from the person. Due consideration shall be given to hearing from possible opposing viewpoints before action is taken when no notice was given that an opportunity to speak would be allowed.

    (d)

    Taking action. No action shall be taken on any matter not on the agenda without the council's unanimous consent.

    (e)

    Closed sessions.

    (1)

    No matter shall be placed on the agenda for closed session except by the city manager.

    (2)

    Matters to be placed on the closed session agenda shall be identified and described as much as possible, with due consideration to confidentiality, on the regular agenda. Therefore, items for closed sessions shall meet the same deadline as other agenda items, except for issues emerging after the deadline and which must be presented to the council before the next regular meeting. The city manager shall inform council members of any closed session agenda item added after publishing the agenda by the most expedient manner available.
