§ 6. How vacancies filled; effect of removal from city by councilman.

  • All vacancies occurring from any cause in the council shall be filled by appointment by the council, by majority vote of all those elected to the council. If the council shall fail to act within 30 days of the occurrence of the vacancy, then the vacancy shall be filled by the circuit court of Rockingham County or the judge thereof in vacation. Any councilman thus elected shall hold office for the term for which his predecessor was elected, unless sooner vacated by death, resignation, removal or other cause. Should any councilman remove his residence from the city during the term for which he was elected, such removal shall operate to vacate his seat on the council.
